Terms of Service
Please read these Terms carefully before using Speafy. They explain what you can expect from us and what we expect from you.
Who We Are and What These Terms Cover
Speafy ("we", "our", "us") is an AI-powered language learning platform operated from Ontario, Canada. These Terms of Service ("Terms") govern your access to and use of the Speafy web application, mobile application, and website at speafy.com (collectively, the "Service").
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of a minor for whom you have parental or guardian responsibility, you are agreeing to these Terms on that minor's behalf and are responsible for their use of the Service.
Eligibility and Account Creation
Age requirement
You must meet the minimum age for your jurisdiction as set out in our Privacy Policy (Section 10) to create an account. By creating an account, you confirm that you meet this requirement.
Account accuracy
You agree to provide accurate, current, and complete information when creating your account and to keep it up to date.
Account security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at privacy@speafy.com if you suspect unauthorised access.
One account per person
Accounts are personal and non-transferable. You may not share your account with others or create multiple accounts to circumvent any limitation or suspension.
Google Sign-In
We currently offer sign-in via Google only. By signing in with Google, you also agree to Google's Terms of Service and Privacy Policy. We receive only the account identity data described in our Privacy Policy.
Free Trial
We offer a 7-day free trial of the Service. No payment information is required to start your trial.
At the end of the 7-day trial period, your access to paid features will end unless you choose to subscribe. We will notify you within the app before your trial expires.
The free trial is available once per user. Creating a new account to obtain additional free trials is not permitted.
Subscriptions and Payment
Subscription plan
After your free trial, you may subscribe to Speafy for USD $4.99 per month (or the equivalent in your local currency as determined by Paddle at checkout).
Billing
Subscriptions are billed monthly in advance. Billing is handled by Paddle, our Merchant of Record. By subscribing, you also agree to Paddle's Terms of Service and Privacy Policy. Paddle is responsible for processing your payment and managing applicable taxes including VAT and sales tax.
Renewal
Your subscription renews automatically each month on the anniversary of your subscription start date. You will be charged the then-current subscription price at each renewal. We will notify you in the app if we change the subscription price before it takes effect.
Cancellation
You may cancel your subscription at any time through the Settings section of the app or by contacting us at privacy@speafy.com. Cancellation takes effect at the end of your current paid billing period. You will retain full access to the Service until that date. We do not offer partial-month refunds.
No refunds
All subscription payments are non-refundable. This includes situations where you do not use the Service during a paid period, or where you cancel before the end of a billing period. If you believe a charge was made in error, contact us at privacy@speafy.com within 14 days of the charge.
Failed payments
If a payment fails, your access to paid features may be suspended until the payment is resolved. Paddle may retry failed payments in accordance with its billing policies.
The Service — What We Provide
Description
Speafy provides an AI-powered Turkish language learning experience including vocabulary lessons, spaced-repetition flashcard reviews, an AI tutor (Baran), practice dialogues, and progress tracking.
AI-generated content
Parts of the Service, including tutor responses, example sentences, and word analyses, are generated by artificial intelligence (Anthropic Claude). AI-generated content may occasionally contain errors or inaccuracies. You should not rely on AI-generated content as a definitive source for medical, legal, financial, or other professional matters.
Disclosure of AI use
The Baran tutor character is powered by the Anthropic Claude API. Interactions with Baran are not interactions with a human. We disclose this use of AI in compliance with applicable regulations including the EU AI Act and Anthropic's usage policies.
Audio content
Pre-generated audio pronunciations are produced using Google Cloud Text-to-Speech (WaveNet). Audio is provided for learning purposes only.
Curriculum
The Turkish language curriculum, including vocabulary, example sentences, and translations, is provided for educational purposes. While we take care to ensure accuracy, we do not guarantee that all content is error-free. If you identify an error, please report it to privacy@speafy.com.
Acceptable Use
You agree to use the Service only for its intended purpose of personal language learning. You must not:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to reverse engineer, decompile, or extract the source code of the Service.
- Use automated tools, bots, or scripts to access or interact with the Service.
- Attempt to gain unauthorised access to any part of the Service, our servers, or any systems connected to the Service.
- Transmit any content through the AI tutor that is harmful, abusive, unlawful, or violates the rights of others.
- Resell, sublicense, or otherwise commercialise the Service or any content generated by it.
- Circumvent any technical measures we use to enforce these Terms.
- Any testimonials or user reviews published on Speafy's website or marketing materials are genuine and reflect real user experiences. We do not fabricate, incentivise without disclosure, or materially edit user feedback.
We reserve the right to suspend or terminate your account if we determine, in our reasonable judgement, that you have violated these Terms.
Intellectual Property
Our content
The Speafy name, logo, branding, curriculum content, software, and all other materials provided through the Service are owned by or licensed to Speafy and are protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership rights in our content.
Your content
You retain ownership of any content you provide to the Service (such as messages sent to the AI tutor). By using the Service, you grant us a limited, non-exclusive licence to process your content solely to the extent necessary to provide the Service to you.
AI-generated outputs
Content generated by the AI in response to your inputs is provided to you for personal learning use. We make no claim of ownership over AI-generated outputs delivered to you.
Feedback
If you provide us with feedback or suggestions about the Service, we may use that feedback without any obligation to you.
Privacy and Data
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy explains what personal data we collect, how we use it, and your rights in respect of it.
By using the Service, you acknowledge that your AI tutor messages are processed by Anthropic's API via our server-side proxy. Please refer to our Privacy Policy for full details of how your data is handled by our subprocessors.
Service Availability
We do not guarantee that the Service will be available at any particular time or without interruption. We may suspend or discontinue the Service, or any part of it, at any time with or without notice for maintenance, upgrades, or any other reason.
In the event that we permanently discontinue the Service, we will provide reasonable advance notice and will offer a pro-rata refund of any prepaid subscription fees for the unused portion of the current billing period. This is the only circumstance in which refunds will be issued.
We are not liable for any loss or damage caused by unavailability of the Service.
Third-Party Services
The Service integrates with third-party services including Google (Firebase, Google Sign-In, Google Analytics, Google Cloud), Anthropic, and Paddle. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service provider.
Links to third-party websites or services on speafy.com are provided for convenience only. We do not endorse and are not responsible for the content or privacy practices of any third-party site.
Disclaimers
"As is" basis
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Language learning outcomes
We do not guarantee any particular language learning outcomes. Progress depends on your individual effort, consistency, and many factors outside our control.
AI accuracy
AI-generated content is not guaranteed to be accurate, complete, or appropriate for any particular purpose. The AI tutor is an educational tool, not a certified language instructor.
Limitation of Liability
To the maximum extent permitted by applicable law, Speafy and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the total amount you paid to Speafy in the three months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Indemnification
You agree to indemnify, defend, and hold harmless Speafy and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
Termination
By you
You may terminate your account at any time by using the account deletion feature in the Settings section of the app. Termination does not entitle you to a refund of any prepaid fees.
By us
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, if required by law, or if we discontinue the Service. We will give you reasonable notice where practicable, except where immediate termination is necessary to protect the Service or other users.
Effect of termination
Upon termination, your right to access the Service ends immediately (or at the end of your current paid period in the case of voluntary cancellation). We will handle your personal data following termination as described in our Privacy Policy.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Effective date" at the top of this page and display a prominent notice in the app the next time you sign in. Your continued use of the Service after the updated Terms are posted constitutes your acceptance of the changes.
If a change materially affects your rights or obligations, we will provide at least 14 days' notice before the change takes effect. If you do not agree with a material change, you may cancel your subscription and delete your account before the change takes effect.

Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. If you are a consumer resident in the European Union, you also retain the right to bring proceedings before the courts of your country of residence under applicable EU consumer protection law.
Nothing in this section prevents either party from seeking urgent injunctive or other equitable relief in any court of competent jurisdiction.
Consumer Rights
If you are a consumer in the European Union, United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in these Terms affects your statutory rights that cannot be waived by contract. In particular:
EU / UK users: You have a 14-day right of withdrawal from a digital service contract. However, by actively using the Service during this period (including accessing lessons or AI features), you expressly acknowledge that you are requesting immediate performance of the service and that your right of withdrawal is thereby waived once the service has been fully performed. If you have not used the Service during the 14-day period, you may withdraw and receive a full refund by contacting privacy@speafy.com.
All consumers: The limitation of liability in Section 12 does not apply to the extent it is prohibited by applicable mandatory consumer protection law in your jurisdiction.
General
Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Speafy regarding the Service and supersede all prior agreements.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
No waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a successor in connection with a merger, acquisition, or sale of assets, with notice to you.
Language
These Terms are written in English. Any translations are provided for convenience only. In the event of any conflict, the English version prevails.
